Shipping Terms and Conditions

Shipment means all documents and parcels that travel under one receipt and which may be carried by any means ERIM chooses, including air, road or any other carrier. Every shipment is transported on a limited liability basis as provided herein. If shipper requires greater protection, higher freight can be arranged at an additional cost.

  1. Waybills does not serve as an Official Receipts. Official Receipts will be given separately by ERIM Representative.
  2. ERIM’s liability for loss shall be as follows:
    • ERIM shall not be liable for damaged item only for loss
    • For shipment with NO DECLARED VALUE liability of ERIM shall be limited to the refund of freight charged.
    • For shipment with DECLARED VALUE, liability of ERIM shall be limited to the value declared in this waybill.
  3. ERIM shall not be liable for loss or damaged item arising from act of God or force majeure.
  4. ERIM shall not be liable for any other damages such as consequential, moral or exemplary damage
  5. Shipper warrants the following:
    • The shipment is properly marked and addressed;
    • The item is properly and securely packed, anticipating impact during transit of the package.
    • All information given is true and correct;
    • That shipment contains no hazardous, prohibited items such as but not limited to drugs, pirated items, guns, explosives, ammunitions and the like.
    • All applicable customs, import, export, and other laws and regulations have been complied with.
  6. Shipper agrees that in the absence of the consignee, shipment may be given to any person at the given address who is of sufficient age and discretion.
  7. Shipper warrants that within the day of delivery, the consignee or any person of sufficient age and discretion is at the given address to receive the shipment.
  8. Online tracking will serve as Proof of Delivery (POD).
  9. Shipper agrees the he is obliged to verify the status of the delivery of the shipments within seven (7) days from date of acceptance of shipment. If shipment is undelivered, the shipper shall claim it within thirty (30) days from date of acceptance. Otherwise, ERIM is authorized to dispose of the shipment in a manner it sees fit.
  10. ERIM shall have lien on any goods shipped for all unpaid freight charges, custom duties or advances or other charges of any kind for the transportation of the shipment.
  11. All claims must be filed within five (5) days from date of delivery, otherwise any claim filed beyond this period will be denied.
  12. In the absence of notation of any damage on the shipment upon receipt by the consignee or any person of sufficient age or discretion, the receipt conforms that the shipments was received in good order and condition.
  13. ERIM may at its option open and inspect the package prior to acceptance from and in the presence of the shipper or his representative for the purpose of inspecting and ensuring that the shipments does not contain hazardous or prohibited items.
  14. The shipper, as owner or his authorized representative, warrants that he understands and voluntarily accepts the terms and conditions of this contract. For the complete terms and conditions, please refer to www.erimexpress.com
  15. Any court arising from this contract, the same shall be brought in the proper court of Cavite City to the exclusion of all other courts.
